1. Acceptance of Terms

Welcome to VoteMyThought ("the Platform"), a digital platform operated by Celestiq Insights OPC Pvt Ltd ("the Company", "we", "us", or "our"), registered at Bangalore, Karnataka, India — 560077. The Platform is accessible at votemythought.com.

By accessing, browsing, registering an account, or using any feature of the Platform, you ("User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Cookie Policy, Copyright & DMCA Policy, and Community Guidelines (collectively, the "Agreement").

If you do not agree with any part of these Terms, you must not access or use the Platform.

2. Nature of the Platform — Intermediary Status

The Platform hosts two categories of content:

• Platform Content: Content created and published directly by VoteMyThought or Celestiq Insights OPC Pvt Ltd. The Company is responsible for this content as its publisher.
• User-Generated Content: Content — including poll questions, descriptions, poll options, and any other submissions — created and published by users of the Platform. The respective users are solely responsible for this content. The Company, as an intermediary, is not liable for user-generated content under Section 79 of the IT Act, 2000, provided the due diligence requirements prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 are observed.

3. User Responsibilities & Prohibited Content

As a condition of using the Platform, you agree not to host, display, upload, modify, publish, transmit, store, update, or share any information that:

1. Belongs to another person and to which you do not have any right;
2. Is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or relating to or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
3. Is harmful to children;
4. Infringes any patent, trademark, copyright, or other proprietary rights;
5. Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
6. Impersonates another person;
7. Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting to any other nation;
8. Contains software viruses or any other computer code, file, or program designed to interrupt, destroy, or limit the functionality of any computer resource;
9. Is patently false and untrue, and is written or published with the intent to mislead or harass a person, entity, or agency for financial gain or to cause any injury;
10. Violates any law for the time being in force in India or any other applicable jurisdiction.

These prohibitions are mandated under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

4. Content License

By creating and publishing content on the Platform, you grant VoteMyThought a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, modify (for technical compatibility purposes only), and display your content on the Platform for the purpose of operating and providing the service.

You retain all ownership rights to your content. This license is limited to the operation of the Platform and does not grant VoteMyThought the right to use your content for any commercial purpose unrelated to the Platform's functionality.

5. Content Moderation & Takedown

5.1 Voluntary Takedown

The Platform reserves the right to remove or disable access to any content that violates these Terms, the Community Guidelines, or applicable law, on a voluntary basis or upon receiving a grievance from any person. Such removal shall not affect the safe harbour protection available under Section 79 of the IT Act, 2000.

5.2 Takedown Upon Court Order or Government Notification

Upon receiving actual knowledge in the form of an order from a court of competent jurisdiction or a reasoned written intimation from an authorised officer of the Appropriate Government or its agency (not below the rank of Joint Secretary or equivalent, or Deputy Inspector General of Police in case of police administration), the Platform shall remove or disable access to the specified unlawful information within thirty-six (36) hours of receipt of such order or intimation, as mandated under Rule 3(1)(d) of the IT Rules, 2021 (as amended in October 2025).

5.3 Commitment to 48-Hour Response

For grievances received from users or members of the public regarding unlawful content, the Platform commits to reviewing and acting upon such grievances within forty-eight (48) hours of receipt, exceeding the statutory requirement where applicable.

5.4 Preservation of Removed Content

Content that has been removed or access to which has been disabled shall be preserved, along with associated records, for a period of one hundred and eighty (180) days from the date of removal, for investigation purposes, or for such longer period as may be required by a court or lawfully authorised government agency, in accordance with Rule 3(1)(g) of the IT Rules, 2021.

5.5 Impersonation, Privacy & Nudity Complaints

In case of complaints relating to content that exposes the private area of an individual, shows an individual in full or partial nudity, depicts sexual acts, or constitutes impersonation in electronic form (including artificially morphed images), the Platform shall take all reasonable and practicable measures to remove or disable access to such content within twenty-four (24) hours of receipt of the complaint, in accordance with Rule 3(2)(b) of the IT Rules, 2021.

6. Grievance Redressal Mechanism

In accordance with Rule 3(2) of the IT Rules, 2021, the Platform has appointed a Grievance Officer based in India. The name and contact details of the Grievance Officer are published on the Platform's footer and are as follows:

The Grievance Officer shall:

• Acknowledge receipt of your complaint within twenty-four (24) hours;
• Resolve the complaint within fifteen (15) days from the date of receipt.

7. Account Registration & Security

To create polls or cast votes on the Platform, you must register for an account. You agree to:

• Provide accurate and complete information at the time of registration, including your email address and username;
• Maintain the security of your account credentials and not share them with any third party;
• Notify the Platform immediately of any unauthorised access to your account;
• Be responsible for all activities that occur under your account.

The Platform does not impose a minimum age requirement for account registration. However, parental guidance is recommended for younger users. The Platform does not knowingly collect personal data from children under the age of 13. If we become aware that we have collected personal data from a child under 13, we will take steps to delete such data in accordance with the Digital Personal Data Protection Act, 2023.

8. No Editorial Control

The Platform does not exercise editorial control over user-generated content. The Platform does not select, curate, modify, or endorse user-generated content. The display of polls on the Platform is determined by algorithmic sorting (e.g., by recency or vote count) and does not constitute editorial endorsement. The Platform's role is limited to providing the technical infrastructure for users to publish and interact with content.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the accuracy, completeness, reliability, or legality of content available on the Platform.

The Platform does not warrant that the service will be uninterrupted, error-free, or secure. The Platform is not responsible for any damage to your device or data resulting from your use of the Platform.

Poll results displayed on the Platform reflect user votes and do not represent the views or opinions of the Company. The Platform is not responsible for the accuracy or truthfulness of any user-generated content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from:

• Your use of or inability to use the Platform;
• Any user-generated content posted on the Platform;
• Any unauthorised access to or alteration of your data;
• Any interruption or cessation of the service.

The Company's aggregate liability for any claim arising out of or relating to the Platform shall not exceed the amount, if any, paid by you to the Company for use of the Platform in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Content you post on the Platform;
• Your violation of these Terms;
• Your violation of any applicable law or the rights of any third party;
• Any misuse of the Platform by you.

12. Account Termination

The Platform reserves the right to terminate or suspend your account and access to the Platform immediately, without prior notice, if:

• You violate any provision of these Terms or the Community Guidelines;
• You post content that is prohibited under Rule 3(1)(b) of the IT Rules, 2021;
• Your conduct is harmful to other users or the Platform;
• Required by law, court order, or government notification.

The Platform shall periodically inform users, at least once every year, about the rules and regulations, privacy policy, and user agreement, and of the right to terminate access for non-compliance, in accordance with Rule 3(1)(c) and 3(1)(f) of the IT Rules, 2021.

13. Third-Party Services

The Platform uses third-party services for hosting and content delivery, including Cloudflare, Inc. These third parties have their own terms of service and privacy policies. The Platform is not responsible for the practices of these third-party services. Your use of the Platform is also subject to the terms of these third-party providers.

14. Intellectual Property

The Platform's design, logo, software, and original content (excluding user-generated content) are the intellectual property of Celestiq Insights OPC Pvt Ltd and are protected under the Copyright Act, 1957 and other applicable laws. You may not copy, reproduce, distribute, or create derivative works from the Platform's intellectual property without prior written consent.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

Before initiating legal proceedings, parties are encouraged to attempt to resolve disputes through good-faith negotiations. If the dispute remains unresolved within thirty (30) days of written notice, either party may initiate legal proceedings.

16. Changes to Terms

The Company reserves the right to modify these Terms at any time. Users will be notified of material changes through the Platform or via email. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. The Company shall inform users of changes at least once every year, in accordance with Rule 3(1)(f) of the IT Rules, 2021.

17. Cooperation with Law Enforcement

The Platform shall provide information under its control or possession, or assistance to government agencies lawfully authorised for investigative, protective, or cyber-security activities, within seventy-two (72) hours of receipt of an order, in accordance with Rule 3(1)(j) of the IT Rules, 2021.
